Terms and conditions
Translation for convenience; the German version is legally binding.
§ 1 Scope
These terms and conditions apply to all orders you place in the online shop konzept-living.de with Konzept 11 GmbH, Waldweg 7, 17321 Löcknitz, Germany ("we"). We do not accept deviating terms of the customer unless we expressly agree to them in writing.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
§ 2 Conclusion of the contract
The presentation of products in the shop is not a legally binding offer but an invitation to order.
You add products to the cart and proceed to checkout. There you log in with your customer account or order as a guest, enter your billing and delivery address and choose a payment method. Before sending the order you see all details once more in an overview, where you can change them or return to the cart. By clicking "Order with obligation to pay" you make a binding offer to buy the goods in the cart. If you pay with PayPal, you then complete the payment with PayPal.
If you choose the PayPal button directly on the product page or in the cart, we take your name, e-mail address and delivery address from your PayPal account and create a guest account for them; you then see the same overview and order as described above.
We accept your offer by an order confirmation by e-mail or by shipping the goods, whichever happens first; the purchase contract is then concluded.
§ 3 Contract language and contract text
The contract is concluded in the language in which you order (German or English). If the versions of these terms differ, the German version prevails.
We store the contract text. You can view, print or save these terms on this page at any time. With a customer account you can also see your orders in your account at any time.
§ 4 Prices and shipping costs
All prices are final prices and include statutory VAT. You are charged in the currency selected in the shop when you order.
We deliver only to addresses in Germany. Shipping is free of charge for you, with no minimum order value.
§ 5 Delivery
The delivery time is shown on each product page and in the cart. For payment by bank transfer it starts when the payment is received.
If a product unexpectedly becomes unavailable after your order, we inform you without delay and refund any payment already made immediately.
§ 6 Payment
The payment methods available are shown at checkout; at present they are PayPal, credit or debit card, SEPA direct debit, Pay Later via PayPal and bank transfer (prepayment). Payments by card, direct debit and Pay Later are processed for us by PayPal; Pay Later is additionally subject to PayPal's terms.
For a bank transfer we send you our bank details after your order; we ship the goods once the payment has been received.
§ 7 Retention of title
The goods remain our property until paid in full.
§ 8 Right of withdrawal
As a consumer you have a statutory right of withdrawal. The details are set out in our information on the right of withdrawal.
§ 9 Voluntary 30-day returns
In addition to the statutory right of withdrawal, we grant consumers a voluntary right of return: you can return goods to us without giving reasons if you notify us of the return within 30 days of receipt. The return is free of charge for you. Write to us at info@konzept-living.de and you will receive all details for the return. We refund the purchase price via the original payment method once the goods have arrived.
The voluntary right of return requires the goods to be unused and complete. Your statutory right of withdrawal and your statutory warranty rights remain unaffected and are not restricted by these conditions.
§ 10 Warranty
The statutory rights for defects apply. For business customers the limitation period for claims for defects in new goods is one year from delivery; this does not apply to claims for damages or in the cases of § 11.
§ 11 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.
In the case of slight negligence we are liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, limited to the foreseeable damage typical for the contract.
§ 12 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office.
